According to the Sickness Insurance and Accident Insurance Ordinances, it is a legal requirement for all employers to register with SZV. If you pay one or more people to work for you and they receive wages, you are considered to be their employer.
Everyone who has one or more employees executing labor is an employer. There are three possibilities:
1. You are established in Sint Maarten and have employees executing labor for you on Sint Maarten.
2. You are established in Sint Maarten, and your employees are executing labor for you outside Sint Maarten (Dutch Caribbean).
3. A foreign company can also be categorized as an employer in Sint Maarten (Dutch Caribbean).
An employer can be a natural person (such as an individual, a sole proprietor) or a legal entity (such as a corporation, an N.V., or a B.V.)

Please take note that if your business is in the private sector and you have employees, you are required by law to register both your business and your employees with the SZV.
